I start all my consultations by saying, “Hey, tell me a story. Why are you here? What do you think brought you to me today?” Much of the consultation will simply involve me getting a better sense of your background and your current situation.

I’ll also ask specific questions related to your financial state. Is your hardship ongoing or temporary? Is your issue linked to genuine hardship (such as losing a job) or to something else? Do you have equity in your home? If so, how much? What are your desires for the property? Would you prefer to keep it or sell it?

I’ll get basic information from you, as well, such as the property address, whether you’ve been served or not yet, and the court case number.

Next, we’ll talk about your options. If you have other debts you want to get rid of, bankruptcy could be an option. A mortgage modification through mediation with the bank could be possible, as well.

I’ll then file a response to the foreclosure complaint, assuming you come to me as soon as you’ve been served with the complaint. If you’ve waited to come in, I can file a motion for continuance or extension to buy us some more time. In all, any action required will be taken as quickly as possible.

Notes From The Field: What’s A Common Misconception About Foreclosure Defense Law?

Many people approach foreclosure defense consultations with the assumption that they’ll essentially get a free house. That is not going to happen. Even if foreclosure is halted or prevented, this will not cancel out or forgive your mortgage debt, and you will still owe the bank the money they loaned you.

If a genuine mistake has been made by you or by the bank, I can generally fix that, but I won’t be able to get you a free home. That simply won’t be possible.
